Title 15 Chapter 11 in the Vermont Statutes outlines the laws that govern child custody in the state. According to the law, when parents are not able to agree on the conditions of a parenting plan, the state gives authority to the court to make decisions about the plan. The court determines the custody agreement by finding out what is in the best interest of the child. Parents who are in the process of creating a parenting plan, or a parent who is preparing to go to court to defend a plan, should know the standards that the court considers when determining what is in the best interest of the child. Here are some of the factors, from the Vermont Statutes, that the judge will look at when deciding if a custody agreement is the best one for the child.
1. The relationship of the child with each parent and the parent's ability to provide the child with love and guidance. The court will look at how well the child gets along with each parent when they decide which parent the child will live with. This also affects how the court will divide parental responsibility between the mother and father. If the child has a strong relationship with one parent, the custody agreement will most likely name that parent as the custodial parent. The other parent should come up with a visitation schedule that will increase the relationship between that parent and the child.
2. The ability of each parent to ensure the child receives food, medical care, clothing, and other material needs. If a parent is not able to provide physically for the child, that parent will not get custody. The parenting plan is created to provide for the needs of the child, and the basic needs of the child are these material needs. The parents must show the court that they are able to provide for the child and that the child will be well taken care of.
3. The capacity of the parents to communicate and cooperate. Many parents in Vermont are encouraged to have a parenting plan where they share the responsibilities of raising the child. A mother or father who is willing to communicate with the other parent and who tries to cooperate about making decisions shows the court that they are putting the needs of the child first. The court is more likely to give this parent more responsibilities in the custody agreement than the other parent, because the parent can be trusted with the child's welfare.
