A simple how to guide that will help you get through the red tape associated with buying investment property in Colombia, without risking government fines or penalizations. Foreign Investors and real estate funds have definitely put Colombia South America on the radar. It seems like Colombia's economy and political stability have created an internal real estate boom which is making investing in the country's properties highly attractive. However, it is important to understand the laws and regulations concerning Colombian real estate prior to making any investment decision. Following these simple steps established by the Colombian "Superintendencia de Sociedades" could save you lots of time, headaches and possibly hefty fines associated with incorrect procedures. Requirements for Buying Property in Colombia from abroad
- Intermediario Cambiario - You are required to use a legally established "Intermediario Cambiario" in order to fund your investment.
An Intermediario Cambiario is basically a financial institution authorized by the Colombian Government to carry out currency exchanges and international bank transfers. Most commercial banks and lending institutions are authorized to carry out this process. Some investors try to take a short cut here using black market money exchange houses or other means which might get them better exchange rates and save them substantial amounts in banking fees, etc., however, if discovered, the fines associated with bypassing the legal intermediario bancario requirements could be pretty hefty.
- Declaracion de Cambio - You must personally fill out and sign what is known as a "Declaracion de Cambio" and more specifically the a form titled "Formulario No. 4" which can be obtained from your legally established Intermediario Cambiario.
This document is signed under penalty of perjury. It will simply ask you to state the origin of the funds (in order to insure that you obtained the money through legal means) as well as other basic financial information and personal data.
- Registro de la Operacion Cambiaria - You or someone legally authorized to act on your behalf (through a power of attorney of other means) must visit either the "Banco de la Republica" or the "Departamento de Cambios Internacionales" and fill out a form for what is known as "Registro de la Operacion Cambiaria". The actual form that you or your representative will need to fill out is called "Formulario No. 11" and it must include the following attachements:
- Certificado de tradición y libertad - This document shows the complete history of the property since it was first registered before a governent office called the "Oficina de Registro de Instrumentos Públicos". If the Certificado de Tradicion y Libertad is not available at the moment you fill out Form 11 you can temporarily use a buy/sell agreement (contrato de promesa de compraventa) or a "contrato del negocio fiduciario".
- If the purchase will be made on credit or through monthly installments for a Residetial Property construction project you will need to attach the "contrato del encargo fiduciario" or a copy of the contract that you signed ("promesa de compraventa" or "contrato de fiducia mercantil") depending on your individual circumstance.
- For construction properties that are not for residential/living purposes you need to attach either the "contrato del encargo fiduciario" the "promesa de compraventa" or the "contrato de fiducia mercantil" whichever applies.
- Deadline for the Registro de la Operacion Cambiaria - You have 3 months after filling out Form 4 for the Declaracion de cambio in order to complete the Registro de la Operacion Cambiaria. This period can be extended for an additional 3 months by visiting the Banco de la Republica and filling out "Formulario No. 17"
- Fines- Careful, failure to comply with the above requirements will put you at risk of being fined up to 200 percent of the value of your investment.
Once you meet all the requirements laid out above and you've purchased your property you can legally, sell, rent, or do whatever you'd like with your newly acquired real estate. You can also freely take the money you've earned from the sale or rental of the property back home or anywhere else for that matter.
