Even though pension endowment plans and foundations are tax-exempt, we as tax-payers may be in for a rude awakening because lawmakers are considering imposing requirements on general partners of investment funds and private equity firms to subject them to unrelated business income tax. They must use these tools to minimize losses and prepare to take advantage of economic and financial market recoveries when they become available.
Strategies must be evaluated to see which work or do not work and accept that markets rise and decline for long periods of time. Times are changing and investors have to make adjustments accordingly. While beneficial owners may realize a substantial gain from tax reclamation, pension funds are positioned to benefit from this service. Since many of these funds are tax-exempt, given the potential benefit of tax recovery, it is no longer an assumption that the fund custodian is filing for reclaims on your behalf. Because of the circumstances in which the reclamation process takes place, many brokerage firms and custodians do not offer a full tax reclamation. As a result, these funds are missing out on certain entitlements.
