It seems we are moving away from being a nation for the people and by the people to a nation that is for the lawyers and by the lawyers, leaving the rest of us to fund their endeavors. Why, I ask? Today's example in this epic long series of articles focuses on General Aviation and how FAA regulation, litigation, and aircraft insurance is dragging the general aviation insurance industry into the ditch. Let's start by reminding you that these are philosophical considerations in this article series spanning many-many sectors of the American way of life.
Thus, this is another philosophical thought on Lawyers and Liability. Not long ago, I talked with an individual who was a pilot with 100-hours and was a member of a college flying club. He was also a member of another club on campus and wanted to use one of the airplanes to transport the group hundreds of miles away for an event. He was unable to do so, because the FBO sponsoring the flying club, was worried about insurance and such.
The liability costs are what are preventing all this; Lawyers, Lawsuits, Insurance, and regulations that favor that side of the coin over the ability for free people to do the things that they want to do. Such as fly to a destination at a reasonable cost. This is the same thing that is happening in Health Care, and why tort reform is needed. It's why renting an aircraft costs so much, why fewer young people are getting into aviation, and why FBOs can barely make it.
It's why half the folks in Wichita are out of work, and why we can't get this VLJ industry off the ground. I am sure it will affect the privatization of space too. This is why I have a problem with lawyers, and perhaps they might one day be denied health care, denied health care insurance, denied the ability to fly, denied driver's licenses, because all they do is mess it up for everyone else, and if they wish to destroy all that, they should be the ones to pay the price, not the society. See that point?
And, perhaps this is why the rental agreements, aviation insurance policies, FARs, and such are so many pages. We have lawyers on both sides, when what we really need are none, and allow personal responsibility to prevail and prudent due diligence. Once again, thanks for listening.
